The Dunedin City Council has voted to sign a contract to build the controversal stadium, but there is still a hurdle to jump.

The go ahead depends on the council surviving a court challenge from opponents of the stadium later this week.

Protest group Stop the Stadium filed proceedings against the council last week, seeking a High Court injunction to stop the project.

The group hoped this would to stop the council from signing a construction agreement on Monday.

But Mayor Peter Chin says councillors on Monday morning received legal advice about the injunction and resolved to defend the proceedings with urgency.

The council voted to signed the contract, giving a guaranteed maximum price for the cost of the stadium.

Stadium Trust Chairman Malcolm Farry says that the bulldozers are ready to go, which could be as soon as next month.

The stadium could be ready for the Rugby World Cup in 2011.
