The Wellington City Council has now accepted responsibility for a faulty fence through which a man fell to his death earlier this month.

Michael Webby died after falling 20 metres down a bank, through a gap in a missing railing in Kelburn's Glenmore Street in the early hours of the morning.

The council initially claimed that residents were responsible for the upkeep of the pathway.

However, chief executive Garry Poole has told Webby's family that they had found paperwork dating back to the 1930s, which confirmed the council is responsible.

The files on the path have now been handed to police and the council has started a review of all private access ways.
