Auckland's Western Springs Speedway could be forced to close following a crucial Environment Court ruling.
The court has just rejected an application to amend an earlier ruling, which forced the race promoter to comply with an 85 decibel noise limit. Springs Promotions says it cannot comply and still run a viable event.
In its ruling, the Environment Court says it is difficult to have sympathy with the two parties, given that they have had 10 years to do something about complying with the noise restrictions.
Judge Thompson says the balance remains on the side of the Residents Association who have asked for nothing more than that the law be complied with.
Auckland's Mayor Dick Hubbard said it is now up to the speedway promoter to see if it can live within the limits this season, and decide if racing continues.
"We're disappointed with the court's decision. We would ask on behalf of the residents of Auckland that Springs Promotions does its very best to complete the season," Hubbard said.
He said the city would pursue every option available to make sure speedway continued at the Springs.
"We want a solution which works - and a speedway which is a considerate neighbour," Hubbard said.
He said tens of thousands of people will be disappointed by the Environment Court decision.
A substantive hearing on the issues will be held at the Environment Court in February.
