Trevor Mallard is being accused of turning the Janet Moses case into a racial issue.

The Hutt South MP has criticised a judge for handing down sentences he says are too lenient for the five family members convicted of the 22-year-old's manslaughter.

She drowned during an exorcism ceremony in Wainuiomata two years ago.

Head of Maori Studies at Victoria University Peter Adds says Mallard's comments - that those convicted weren't sent to prison because they are Maori - is based entirely on assumption.

He says he is disappointed Mallard is turning the case into a racial issue.

Adds says there needs to be greater recognition of different cultural practices within the judiciary.
