UPDATED: The jury in the Clayton Weatherston murder trial will
return to court shortly. A verdict is imminent.
Deliberatiosn resumed at about 9:30am after spending the night at home.
The 11 jurors spent around three hours on Tuesday considering whether the former Otago University tutor murdered his former girlfriend Sophie Elliott, or if he was provoked and therefore guilty of manslaughter.
In summing up in the High Court at Christchurch on Tuesday, Justice Potter told the jury the Crown has to prove whether Weatherston had murderous intent when he stabbed Elliott 216 times.
She said if they prove that, then they also have to look at the pivotal issue of the case - whether the defence of provocation can be applied.
Potter also told the jury to set aside any feelings of sympathy or prejudice.
The jury decided to go home for the night just after 5pm Tuesday.
