Road rage assault accused stays in custody

The Auckland man alleged to have committed a road rage assault on a grandfather who later died will stay behind bars for at least another two weeks.

Bio O'Brien, 27, a student at Unitec from the Pacific Island nation of Tuvalu, reappeared in Auckland District Court on Thursday charged with assaulting Jashmatbai Patel, 78, of Te Atatu.

Patel, the driver of a van, was attacked after what police called a "minor crash" with a BMW outside Unitec on Carrington Rd, Mt Albert about 8am on Tuesday.

He was admitted to Auckland Hospital shortly after the alleged assault and died on Wednesday.

In his brief appearance, O'Brien was remanded in custody until April 27 after his lawyer David Niven did not seek bail. 

Police said following Patel's death, they were now conducting a homicide inquiry but no further charges were laid on Thursday.

Judge David Harvey on Thursday decided to allow images of O'Brien to be taken in court and published after it was denied the day before.
