ACC is being accused of treating its clients unfairly following revelations a senior staff member is suing a sexual abuse victim for $250,000.

ACC manager Peter Jansen claims the abuse victim defamed him when she blogged on the internet about a friend's failed attempts to get help from the service.

For legal reasons, her complaint can't be published, but she was critical of Jansen, a senior member of ACC's sensitive claims unit.

Labour's Spokesperson for Victims' Rights Carmel Sepuloni today questioned National about the case, asking if it thought it was fair for a senior medial advisor to be suing an ACC claimant for "speaking her mind".

ACC minister Nick Smith was not at parliament today but his office says he was unaware of the $250,000 lawsuit and is now investigating.

Doctor Jansen would not talk to ONE News about the case.

ACC says he is taking the action as a private citizen and he is paying his own legal expenses.

The claimant, who wanted financial help from ACC, says her experience with the corporation is that it just "does not want to help".

"I don't understand what the purpose of this lawsuit was. Is it to make me go away or what?" she said.

She says she will be spending what money she has on legal advice.
