The Department of Labour will not be taking action against dive company, Helix, following an accident in July last year where two divers drowned in Auckland's Lake Pupuke.

Daniel Stoneham, 33, and Tyrone North, 37, were nearing the end of a five-month course with Helix, when they failed to surface on July 15.

The department said today that it conducted a full investigation into the accident which concluded that there had been no breach of the Health and Safety in Employment Act by Helix.

The department would not be taking any enforcement action against Helix.

The department said it will provide its report to the Coroner's Office for the purpose of any inquest and is unable to comment further while a coronial process is ongoing.
