David Bain defence team request exhibits

ONE News has learned that after David Bain was found not guilty of murdering his family, he and his defence team applied to get most of the exhibits, including the murder weapon, returned to them.

Bain, 37, was acquitted of murdering his parents and three siblings at their Dunedin home in 1994 after a retrial in the High Court at Christchurch in June.

He had spent 13 years in prison after originally being convicted of the crimes in 1995.

It has now been three months since the acquittal and around 500 exhibits are still in Christchurch.

Bain's lawyer Helen Cull has confirmed that his defence team put in an application to get many of the exhibits, including the rifle used in the murders, returned to them.

She says that they did so in order to ensure that the exhibits were not destroyed or lost.

The prosecution says it wouldn't want anything released until a number of issues including Bain's compensation claim are sorted out.

Until then, ONE News understands the application is in limbo.

There is also a possibility of a second inquest into the Bain deaths.
