Cushion assault case thrown out of court

Police have been blasted as ridiculous and petty after charging a man with assault after he hit a young family member with a cushion.

The charge was set to go to a jury trial on Tuesday until a judge threw it out of court.

George Taylor walked out of court a free man but he could have had a conviction of assault on a child against his name.

Taylor been charged after he hit a six-year-old boy with a cushion last New Year's Eve in response, he says to the boy giving him some lip.

"He kept doing it, so playfully I picked up a pillow and chucked it at him, and well, I got arrested," Taylor says.

According to the Crown's own evidence the boy was struck on the head only once, was not injured, and did not even cry.

"No, no he just cussed me some more," says Taylor.

However, the boy's mum called police who charged Taylor with assault. The Crown then pursued the charge for 11 months through a depositions hearing to trial.

"I think it's ridiculous, it's just a waste of taxpayer's money, my time and their time," says Taylor.

Even on Tuesday the Crown was still arguing that a jury should decide the case.

The judge said a trial could potentially damage the boy and dismissal was in the overall interests of justice.

Taylor admits he is no angel with convictions for drug-dealing, armed robbery and assaults on his partners.

Taylor says that he would never hurt a child though and he has no previous convictions for harming a child which is a record he is pleased is still intact.
