Picket defence calls first witness

The first defence witness has been giving evidence in the case of a death on a picket line at the Port of Lyttelton in December 1999.

Derek Paul Powell, 53, is charged with the manslaughter of Christine Clarke, who died from head injuries two days after being hit by his vehicle.

Philip Seque told the High Court he was driving past the picket-line when he saw a struggle develop between the accused and a picketer who had put his arms through the driver's window. .

The evidence contradicts that of several prosecution witnesses.

Earlier, Powell's lawyer told the Court the police were aware of the testimony and refused to present it in evidence.

However Detective Anthony Hill told the court that at the time he did not believe it was credible.
