No refund for liquor ban convictions

Almost 600 people convicted for breaching Tauranga's liquor ban will not be reimbursed for their fines, despite being caught while the ban was legally invalid.

The Tauranga District Council was required to have three advertisements for the ban published to make it legal, but only two were printed.

Mayor of Tauranga, Jan Beange, says despite the mistake the council will not revoke the fines.

She says if those convicted for breaking the ban while it wasn't in place want a refund or their conviction overturned, they will have to appeal.

Police Inspector Murray Williams says those who were caught were still breaching the bylaw, even though it was not technically in place at that time.

He says he doesn't expect many people to appeal.

Inspector Williams says staff have not been policing the liquor ban since they found it was not legal, but will return to doing it when a new one is introduced.
