Objectors head to Appeal Court

Maori who object to the building of a prison at Ngawha in Northland are planning a direct approach to the Court of Appeal as a last resort.

The objectors lost a High Court appeal and the judge has refused them leave to appeal against his decision.

Their lawyer, Prue Kapua, says neither the Environment Court nor the High Court has dealt adequately with a crucial Resource Management Act requirement to provide for Maori cultural beliefs and taonga.

Kapua says in this case it involves a taniwha at the prison site. She says the appellants are also concerned the courts gave more weight to the small group that supports the prison.

Kapua says it is important for all Maori that those issues are given another hearing by the appeal court, and by different judges.
