Visa Entertainment New Zealand / TVNZ / Britney Promotion Terms and Conditions

Information on how to enter the Promotion forms part of these Terms and Conditions. Entries not made in accordance with these Terms and Conditions will be disqualified.

Section 1: Promotion

Promotion: Enter the competition online at http://www.tvnz.co.nz/breakfast-news  between 6 November and 12 November 2009 (before 5 pm) and include at least 3 of the 5 clues screened on Breakfast between 7:45 am and 8:00 am from November 6 to 12 to go in the draw for a chance to win a VIP package for 6 people to the Britney Spears Concert on Friday 20th November 2009 in Sydney, Australia.

Promotion Period: The Promotion will commence at 7 am (NZDT) on 6 November 2009 and will close at 5pm (NZDT) on 12 November 2009.

Section 2: Eligibility

Eligibility: To be eligible to enter the Promotion the entrant must:

Enter their valid details on the website; and

Correctly answer a related question [TBC]

Be aged 18 years or older. If the winner is aged under 18, they must be accompanied by at least one adult (who will count as one of the five people they can select to accompany them).

Non-Eligibility: Entrants are not eligible to enter the Promotion or win any Prize if they are a director, manager, an employee or immediate family member of an employee of the Promoter or are an employee of their agencies directly associated with this Promotion.

Incorrect contact details: Further, if any contact details provided to TVNZ via the Website are incorrect, such entry shall not be eligible to enter the Promotion.

Section 3: Entry to the Promotion

Eligible entrants who enter their details at the TVNZ website will automatically receive one (1) entry to the Promotion.

Section 4: Draw

Draw:

A random draw will take place on 13 November 2009.

The Prize Winner will be manually selected at random by a representative of the Promoter from a computer-generated listing of entries which comply with Section 2 and 3 of these Terms and Conditions over the Promotion Period.

If the Prize Winner is not available to accept the prize then the prize will be forfeited and a new winner drawn at random.

Prize Winners: The Prize described below in Section 5 will be awarded to the first valid entry drawn.

Section 5: Prize

Number of Prizes: There is one prize for six people to be awarded in this Promotion. Details relating to the Prize are set out in Clauses 13 and 14.

Prize Value: The value of the Prize is up to NZD$25,000 (inclusive of GST).

Prize Conditions: The Prize is subject to the following conditions:

No exchange of Prize: The Prize in its entirety can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take the Prize then the Prize will be forfeited.

Ancillary Costs: Any costs in excess of the value of the Prize and all ancillary costs are not included in the Prize and are the responsibility of the Prize Winner. The winner will be responsible for any costs associated with travelling to Auckland to take up the prize. If the winner wants to extend their stay in Sydney they can do so at their own cost - any cost to transfer flights and/or accommodation must be paid by the winner.

Taxes: There is no tax applicable to the prize value.

Prize Availability: In the event that the Prize is unavailable for any reason at any time, the Promoter reserves the right to substitute the Prize with another prize of equal value and the Prize Winner will be notified accordingly.

Meet & greet time and details are subject to change, but the promoter will endeavour to confirm time and details with the winner 7 days prior to the tour date.

Section 6: Prize Winner

Contact: The Promoter will attempt to contact the Prize Winner by phone or email by 13 November 2009 to confirm his/her eligibility under these Terms and Conditions and to confirm whether the Prize Winner wishes to claim his/her Prize. The name of the prize winner will be published on the TVNZ and Visa Entertainment website.

Claim of Prize: If the Prize Winner wishes to claim their Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these Terms and Conditions within 24 hours of contact. If the Prize Winner fails to do either or both of these things by the deadline, the Prize Winner will be deemed to have forfeited the Prize.

Redraw: In the event that any Prize Winner forfeits the Prize or a Prize remains unclaimed, the Promoter will conduct a redraw, following the same procedure and format as set out under Section 4 above.

Redraw Winner: In the event that this redrawn Prize Winner is not eligible, the Promoter will conduct a redraw until the Prize is awarded (subject to any further regulatory directions).

Winner Publicity: In accepting the Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter. The Prize Winner further acknowledges and agrees that the Promoter reserves the right to publicise their names, addresses and photographs in respect of this Promotion without any payment being made to them.

Section 7: General Conditions

Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.

Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner, release the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoter, their related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this Promotion, the implementation of this Promotion, or the use of any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Force Majeure: The Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter and subject to State legislation the Promoter reserves the right to cancel, terminate modify or suspend the Promotion.

Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
